However, it is better if you apply for fiancé visas or spouse visas via a professional who is used to doing all this paperwork. Even if one tiny detail is overlooked, your application can get rejected and you will have to go through the process all over again. You and your fiancé need to be well prepared that this might take a while.
If you want to bring your Filipina fiancé to the USA, there are 2 kinds of visas that you can apply for- the fiancé visa or the spouse visa. With a fiancé visa or a K1 visa, you will have to marry your Filipino fiancé within 90 days of living in the USA since the fiancé visa expires within 90 days in the Philippines. You will need to provide documents proving your relationship to both the US authorities and the authorities in the Philippines. Only after both these authorities are satisfied, will your fianc©e be allowed to leave her country.
If you apply for a spouse visa, you will first have to get married to your Filipina girlfriend. Only then can you apply to migrate your wife to your country. If you are getting married in the Philippines, you must apply for a proper marriage certificate. You will need to bring several documents along with you in order to make the marriage legal. Your passport, an affidavit from the US embassy, the death certificate of your spouse if you were previously married as well as proof that you have informed your parents must be presented at the time of marriage. The last condition only applies if you are between the age of 22 and 24. If you are between the age of 18 and 21, you must get proof of parental consent. Only after all these documents have been provided, will the marriage be deemed legal.
